  • Sworn complaint filed in U. Florida gambling case

Gainesville, Florida (U-WIRE) -- A sworn complaint filed Thursday in the Alachua County Courthouse against a University of Florida graduate connects him with two crimes in relation to gambling allegations surrounding a UF athlete.

The complaint, which lists former UF guard Teddy Dupay as a co-defendant, recommends that Kresten R. Lagerman, of Palm Harbor, who graduated in the spring of 2000, be charged with misdemeanor unlawful betting and felony tampering with evidence.

This comes one week after University Police announced an end to its gambling investigation into a student-athlete and Dupay was declared ineligible to play college basketball his senior season.

The complaint states that since January 2000, Lagerman placed bets on collegiate and professional basketball games, including the Gators. There is no suspicion of point-shaving in the complaint or in the University Police investigation. "Dupay gave information to Lagerman on whether the UF basketball team could cover published or known point spreads that Lagerman and others were interested in wagering on," the complaint states.

State Attorney Bill Cervone said the University Police's investigation, which totals 30-35 pages, had been sent to the courthouse.

Sources close to the investigation said UPD recommended Dupay be charged with misdemeanor gambling, as well as felony obstruction of justice.

"A sworn complaint can include all related charges concerning an individual in a specific case," Cervone said. "I need to make sure I'm not misinterpreting something before we decide if there is anything further to do."

Cervone said he did not want to elaborate on whether a complaint would be filed against Dupay and whether that complaint would go along with the University Police's recommendation.

"It was all part of a package they sent to me," Cervone said. "The complaint I sent includes all charges related to the individual the complaint is against."

The complaint filed Thursday states that Lagerman, on more than one occasion, received money from bets he placed with a bookie and he shared some of the proceeds with Dupay. Lagerman told police he placed about 10 to 15 bets on collegiate and professional teams, according to the complaint.

Lagerman would not comment on his involvement. His mother, who refused to give her name, said her son is aware of the charges and has retained the services of an attorney.

According to the complaint, Lagerman also withheld testimony and records from the University Police's criminal investigation into gambling allegations of a student-athlete, which the complaint confirms is Dupay.

"Lagerman engaged in misleading conduct with various people involved in the UPD investigation," the complaint states.

The complaint states Lagerman gave untruthful statements to protect himself and Dupay.

Dupay was declared ineligible to play his senior season for UF by Athletics Director Jeremy Foley last week. During his press conference, Dupay admitted to some wrongdoing.

"I understand that I have violated NCAA rules and I take full responsibility for those actions," Dupay said. "I put myself in a situation that I should not have put myself in and I am paying the price for that."

Foley said the NCAA had been informed throughout the investigation -- which began April 5th -- and it determined the problem was an "individual eligibility issue, and not an institutional issue."

Dupay is a 5-foot-11 guard who ranks third in school history with 188 career three-pointers and second in history with 496 attempts. Dupay ranks seventh on UF's career free-throw percentage chart with .804 and tied for 10th on UF all-time assist chart with 253. He averaged 13.4 points per game as a junior and 10.7 for his three-year career.
